Tableside Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the Tableside applications for iOS and Android and this website (collectively, the "Service"), operated by Setout Labs LLC, a Delaware limited liability company ("Setout Labs", "we", "us", or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

To use the Service, you must:

Be at least 13 (or the minimum age in your jurisdiction that allows you to consent to online services).
Have the legal capacity to enter into a binding agreement with Setout Labs.
Use the Service only in compliance with these Terms and applicable law.

2. Accounts and security

Some features require signing in with Apple, Google, or an email and password. You agree to provide accurate account information, keep your sign-in credentials secure, and take responsibility for activity under your account. Tell us at support@tble.co if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.

3. Nutrition estimates are not medical advice

Tableside provides approximate nutrition estimates generated by AI, for general informational purposes only. It is not a medical device and does not provide medical, clinical, or dietetic advice, diagnosis, or treatment. Always consult a qualified professional about your health and diet, and never disregard professional advice because of something in the app. Do not rely on Tableside for decisions where inaccurate nutrition information could affect your health, such as managing a medical condition or a severe allergy.

4. Subscriptions and billing

4.1 Purchases through app stores

Tableside may offer free and paid features. Paid subscriptions are sold and billed through the Apple App Store or Google Play under your store account, and are governed by that platform's terms and refund policies. We do not control and are not responsible for their billing practices. To manage, cancel, or request a refund, use that platform's account settings or support channels.

4.2 Renewals and cancellations

Unless otherwise stated at sign-up, subscriptions renew automatically at the end of each billing period at the price shown when you subscribed or as otherwise communicated before renewal. You can cancel anytime in your App Store or Google Play account settings; cancellation takes effect at the end of the current billing period. We generally do not provide prorated refunds for partial periods, subject to applicable law and app store policies.

4.3 Price changes and taxes

We may change subscription prices from time to time. Changes apply on the next billing period after we provide notice, in accordance with applicable law and platform rules. Prices may exclude taxes, which may be charged in addition and vary by location.

5. Your content

5.1 Your ownership

"Content" means the meals, weights, notes, photos, and messages you add to Tableside, along with associated metadata. You retain your rights to your Content, subject to the rights granted in these Terms.

5.2 License to operate the Service

You grant Setout Labs a worldwide, non-exclusive, royalty-free license to host, store, process, and display your Content solely to operate, maintain, improve, and provide the Service to you, as described in our Privacy Policy (for example, syncing across devices, backups, and generating nutrition estimates).

5.3 Your responsibilities

You are responsible for your Content and for having the rights to submit it, and for ensuring it does not infringe third-party rights or violate applicable law. We do not routinely review Content but may remove or restrict access to Content that we reasonably believe violates these Terms or the law.

6. Acceptable use

You agree not to:

Use the Service for any unlawful, harmful, fraudulent, or misleading purpose.
Upload malicious code or take actions that could damage, interfere with, or disrupt the Service.
Attempt to gain unauthorized access to the Service, other accounts, or our systems.
Reverse engineer or attempt to extract source code from the Service, except as permitted by law.
Misrepresent your affiliation with any person or entity.

7. Intellectual property

Except for your Content, all rights in and to the Service, including its software, design, text, graphics, logos, and trademarks, are owned by Setout Labs or our licensors and protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use. You may not copy, modify, distribute, sell, or lease any part of the Service except as permitted by law.

8. Third-party services

The Service relies on third parties, including Apple and Google sign-in and billing, cloud hosting and sync, analytics and crash reporting, and AI providers used to estimate nutrition and answer questions. Your use of those services is governed by their own terms and privacy policies, not these Terms, and we are not responsible for them.

9. Termination

You may stop using the Service and delete your account at any time from the app's settings or by contacting us, as described in our Privacy Policy. We may suspend or terminate access if you materially or repeatedly breach these Terms, pose a security, legal, or operational risk, or as required by law or a platform provider. Provisions that by their nature should survive termination, such as intellectual property, disclaimers, limitations of liability, and dispute resolution, will survive.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not guarantee that nutrition estimates are accurate or that the Service will be uninterrupted, secure, or error-free, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law.

11. Limitation of liability

To the fullest extent permitted by law, Setout Labs and our affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total liability for any claim relating to the Service or these Terms will not exceed the greater of the amount you paid us in the 12 months before the claim or fifty U.S. dollars (USD $50). Some jurisdictions do not allow these limits, so they may not fully apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Setout Labs and our affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your Content, your violation of these Terms or any law, or your infringement of any third-party right.

13. Governing law and dispute resolution

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, except where mandatory law in your country of residence requires otherwise. You and Setout Labs agree to the exclusive jurisdiction of the state and federal courts in Delaware, except where applicable law gives you a right to bring actions in your local courts. Nothing here limits non-waivable consumer-protection rights.

14. Changes

We may update these Terms to reflect changes in the Service or the law. For material changes we'll give notice through the Service or by email before they take effect, and we'll revise the date above. Continuing to use the Service after changes take effect means you accept the updated Terms.
